1. Acceptance of Terms

By accessing and using Varsity Recruiting Manager ("VRM", "Service", "Application"), you accept and agree to be bound by the terms and provision of this agreement. If you do not agree to these Terms of Service, please do not use the Service.

2. Description of Service

VRM provides a web-based application to help high school athletes and their families manage the college recruiting process, including:

  • Tracking communications with college coaches
  • Monitoring NCAA compliance rules
  • Managing recruiting calendars and deadlines
  • Organizing recruiting materials and information
  • Receiving email notifications and reminders

3. User Accounts

3.1 Account Creation

  • You must provide accurate and complete information when creating an account
  • You are responsible for maintaining the confidentiality of your password
  • You are responsible for all activities that occur under your account
  • You must be at least 13 years old to create an account (with parental consent)

3.2 Account Security

  • Notify us immediately of any unauthorized use of your account
  • Do not share your account credentials with others
  • We are not liable for any loss or damage from your failure to protect your account

4. User Conduct

You agree NOT to:

  • Use the Service for any illegal purpose or in violation of any laws
  • Violate NCAA rules or regulations
  • Upload or transmit viruses or malicious code
  • Attempt to gain unauthorized access to the Service or other users' accounts
  • Harass, abuse, or harm another person through the Service
  • Impersonate any person or entity
  • Interfere with or disrupt the Service or servers
  • Use automated systems (bots, scrapers) without permission

5. User Content

5.1 Your Content

You retain ownership of any content you submit to VRM (coach information, notes, tasks, etc.). By submitting content, you grant us a license to use, store, and display your content solely for the purpose of providing the Service.

5.2 Content Responsibility

  • You are solely responsible for the accuracy of information you provide
  • Do not submit false or misleading information
  • We reserve the right to remove content that violates these Terms

6. NCAA Compliance Disclaimer

IMPORTANT NOTICE:

VRM provides general guidance based on publicly available NCAA rules. However:

  • We are NOT the official NCAA and do not represent the NCAA
  • NCAA rules change frequently and may vary by division and sport
  • Our compliance tracking is for informational purposes only
  • You are responsible for verifying current NCAA rules
  • Consult with your high school compliance officer or the NCAA Eligibility Center
  • We are not liable for any NCAA violations or eligibility issues

7. Intellectual Property

The Service, including its design, functionality, code, and content (excluding user content), is owned by VRM and protected by copyright, trademark, and other intellectual property laws. You may not:

  • Copy, modify, or distribute the Service
  • Reverse engineer or decompile the Service
  • Remove any copyright or proprietary notices
  • Use our trademarks without permission

8. Service Availability

  • We strive for 99.9% uptime but do not guarantee uninterrupted access
  • We may modify, suspend, or discontinue the Service at any time
  • We may perform maintenance that temporarily interrupts service
  • We are not liable for any downtime or service interruptions

9. Fees and Payment

9.1 Current Beta (Free)

During the beta period, VRM is provided free of charge. We reserve the right to introduce paid subscription plans in the future.

9.2 Future Paid Plans

  • Beta users will receive advance notice before any paid plans are introduced
  • Pricing and payment terms will be clearly disclosed
  • You may cancel your account at any time if you do not wish to pay

10. Termination

10.1 By You

You may terminate your account at any time through the Settings page or by contacting us.

10.2 By Us

We may suspend or terminate your account if you:

  • Violate these Terms of Service
  • Engage in fraudulent or abusive behavior
  • Fail to pay fees (if applicable in the future)
  • Create a risk of legal liability

10.3 Effect of Termination

Upon termination, your access to the Service will cease, and your data may be deleted after 30 days.

11. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, VRM SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM YOUR USE OF THE SERVICE.

13. Indemnification

You agree to indemnify and hold VRM harmless from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from your use of the Service or violation of these Terms.

14. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by email or through the Service. Continued use of the Service after changes constitutes acceptance of the new Terms.

15. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States and the State of [Your State], without regard to its conflict of law provisions.

16. Dispute Resolution
